Scottish Court Jury's : Not Proven Verdict (Bastard Verdict)

剛才深讀蘇格蘭獨立公投的一些文章; 突然想起卅多年前,在自行研讀 "Maritime Laws & Cases" (Charter Party Cases) 時, 曾讀到英美法法庭中,由陪審團可作出三種判决之一,即 Quilty, Not Quilty, or "Not Proven"; 這是全世界獨有的制度,也是蘇格蘭人自豪的一點; 勿論英美法系,或大陸法糸,近年隨社會演化,都在作重大的改變,; 我們司法院仿日本的觀審制度,都在他的娘胎裡,吃羊水呢!
